When you’re developing a product, it is only natural that you will want to protect it, so that you can stop your competitors from muscling in on your market share. Many people think the best/only way to do that is to have a patent. And then try to design a product specifically to try and get it patented. But don’t design to patent! Instead, design to sell, and protect what sells it.
Design to Sell
Try to stay focused on your market, when designing a new product. What will sell? And at what price? And once you are clear on that, then look at what elements you can protect. There is no point in over-engineering an otherwise simple product, just to get a patent. Especially if nobody wants to buy it because it costs too much, or you run out of money because it’s taking so long just to get something launched.
Design for your market, come up with a product you think will sell, at a price people will pay. Then look at what elements of its USP could be protected by patents, registered designs and/or registered trade marks. You can always expand your product line later, by developing (and protecting) better/improved versions, with more functions or features, once you’ve tested the market with your first product, and generated a revenue stream for your business.
Don’t design to patent, instead, design to sell, and protect what sells it! And don’t forget to keep it confidential until it’s protected.
